Terms & Conditions
I. Order Cancellation:
All orders are made to your specifications, therefore, cancellations are only permitted before production begins.
II. Shipping and Delivery:
All orders are shipped F.O.B. Art Leather by common carrier at ground service level. Deliveries are sent to full addresses only, we can not ship to PO Boxes. Accelerated shipping is available upon request for an additional charge.
III. Damaged Packages:
Damaged packages are the responsibility of the common carrier. Refuse damaged cartons if you suspect the merchandise is damaged. Do not discard the shipping carton until inspected by the carrier.
Inspect all packages within 48 hours of receipt and notify Art Leather’s customer service of any discrepancy or damage.
IV. Returns/Exchanges:
Custom Products may not be Returned/Exchanged. All other products must be in resaleable condition and are subject to a 15% restocking charge. All returns/exchanges must be authorized in advance and have a Return Merchandise Authorization (RMA) number. Contact Customer Service at 1-866-302-0278 or email customercare@artleather.com for authorization.
Returns/Exchanges must be made within 60 days of invoice date.
V. Return Merchandise Authorization(RMA):
Products cannot be returned without first contacting Art Leather’s customer service for a Return Merchandise Authorization. If it is determined that the product may be defective you will be given an RMA number and instructions for product return. Any unauthorized return, whereby an RMA was not issued will be returned to you at your expense.
VI. Credit Terms:
Credit Cards: We accept American Express, Visa, MasterCard and Discover cards. Beginning July 26, 2010, payments will be charged to your credit card at the time the order is placed.
Open Account: Open Account may be available for those with exemplary credit. Contact our Credit Department at 1-866-302-0278 or email credit@artleather.com for details. Payment for each invoice is due by the 10th day of the month following the invoice date. A service charge of 1 1/2% per month (18% annually) will be applied to all outstanding invoices after 45 days.
COD: COD shipments must be approved by the credit department in advance of placing your order. A separate COD fee is charged for each delivery. An authorized employee must be available to accept and pay for the shipment. If a shipment is refused for any reason, other than damages, the studio is responsible for the shipping and COD fees. If payment is not collected at the time of delivery the studio is responsible for any outstanding balance.
Returned Checks: There is a $45 fee for any returned check.
VII. Refunds/Credits:
After we receive and process your return, if a refund/credit is due to you, it will be processed under the same terms as the original purchase.
VIII. Limit of Liability on Prints Provided by Customers:
We use every precaution to safeguard your prints in the handling and processing of your order, should Art Leather damage a print during its production process, our liability will be limited to replacement of the print at industry standard rates. Shipping charges incurred with replacement prints will be at postal or standard ground rates. This limited liability does not include ink jet prints. Art Leather assumes no liability on ink jets prints; replacements are the responsibility of the buyer. Any other recovery for damages is excluded. Art Leather is not responsible for loss, damage or delay of shipment caused by the U.S. Postal Services, UPS, FedEx or any other carrier.
IX. Limited Warranty:
Our products are guaranteed to be free from defect in workmanship under normal and intended use for a period of 60 days from the invoice date, or unless covered by our lifetime guarantee as stipulated herein.
Products under Lifetime Guarantee on Workmanship:
Futura 700F Covers, Onyx, Hi-Key, Metro Futura Galaxie 7000F Covers,
Perma-Bound Covers (400F and 600F) Onyx, Galaxie 4000F Covers
Sixty (60) Days from Invoice Date
All other covers - defect in material and workmanship.
Our Limited Warranty and Warranty Period: When we use the terms “we”, “us” and “our”, we are referring to the Company, and when we use the terms, “you” and “your” we mean the buyer and/or the end-user customer. When we use the term defective product, we mean defective workmanship.
If our product fails to meet our limited warranty during the warranty period, Art Leather will either, at our option, (a) repair the product free of charge or (b) provide you with a replacement of comparable value. No warranty liability shall exceed the net price (the price minus the shipping and handling cost).
What our Limited Warranty does not cover: We offer this limited warranty only when the product is used by buyer or end-user customer. We offer no other warranty. Additionally, while our warranty is excellent there are other limits to it. We offer NO Warranty in case of damage in transit or inadequate care, abuse, misuse, accidents, damage due to environmental or natural elements.
Limitation on Damages: IN NO EVENT SHALL WE BE LIABLE FOR INCIDENTAL, COMPENSATORY, PUNITIVE, CONSEQUENTIAL, INDIRECT, SPECIAL OR OTHER DAMAGES. OUR AGGREGATE LIABILITY WITH RESPECT TO DEFECTIVE PRODUCTS IS LIMITED TO REPLACEMENT OF, OR THE MONIES PAID TO US, FOR THE DEFECTIVE GOOD. EXCEPT TO THE EXTENT PROHIBITED BY APPLICABLE LAW.
There are no warranties which extend beyond the face of the limited warranty, Art Leather, LLC disclaims all other warranties, express or implied regarding its products, including implied warranties of merchantability, fitness for a particular purpose or non-infringement on any patent. Except to the extent prohibited by applicable law.
